July 14, 2010) Under the authority of subsection 15(4) of the Rail Service Act, 2009, the Lieutenant-Governor in Council makes the following regulations. Dated at St. John's, July 9, 2010. Gary Norris REGULATIONS Analysis 1. Short title 2. Definitions 3. Delegation to board Short title 1. These regulations may be cited as the Rail Service Administration of Delegation Regulations. 2. In these regulations (a) "adopting
regulations" means the Rail Service Accident and Incident
Investigation Regulations, made by the minister under subsection 15(3)
of the Act; (b) "board"
means the Canadian Transportation Accident Investigation and Safety
Board established by section 4 of the Canadian Transportation Accident
Investigation and Safety Board Act; (c) "minister"
means the minister appointed by the Executive
Council Act to administer the Act; and (d) "rail
service" means a rail service that a company is authorized
to construct and operate, and includes all branches, sidings, stations, depots,
wharves, rolling stock, equipment, works, property and works connected with the
rail service, and all rail service bridges, tunnels or other structures connected
with the rail service, and undertakings of the company. Delegation to board 3. The administration of the
following provisions is delegated to the board insofar as they relate to the purpose of conducting investigations into transportation
accidents, incidents and situations or conditions that could, if left
unattended, induce an accident or incident concerning
or related to a rail service regulated under the Act (a) the provisions of the Canadian
Transportation Accident Investigation and Safety Board Act adopted by the
minister under the adopting regulations; and (b) the provisions of the Transportation Safety Board Regulations, SOR 92-446, adopted by the
