Animal Protection Standards Regulations (Amendment)
under the
Animal Health and Protection Act

(Filed April 1, 2019)

Under the authority of sections 29 and 66 of the Animal Health and Protection Act, I make the following regulations.

        1. (1) Subsection 4(1) of the Animal Protection Standards Regulations is repealed and the following substituted:

             (1)  The following codes or standards are adopted but their provisions respecting transportation and appendices are not adopted unless it is specified in this subsection:

             (a)  Code of Practice for the Care and Handling of Beef Cattle, published by the National Farm Animal Care Council, including Appendix F "Euthanasia - Secondary Kill Steps: Bleeding Out and Pithing";

             (b)  Code of Practice for the Care and Handling of Veal Cattle, published by the National Farm Animal Care Council, including Appendix I "Methods of Euthanasia" and Appendix K “Secondary Steps to Cause Death”;

             (c)  Code of Practice for the Care and Handling of Sheep, published by the National Farm Animal Care Council, including Appendix L "Euthanasia";

             (d)  Recommended Code of Practice for the Care and Handling of Farm Animals - Goats, published by the Canadian Agri-Food Research Council, including Appendix D "Guidelines for Humane Killing of Goats by Firearms";

             (e)  Code of Practice for the Care and Handling of Pigs, published by the National Farm Animal Care Council, including Appendix A "Guidelines for Determining Individual Stall Sizes for Gestating Gilts and Sows", Appendix B "Recommended Minimum Floor Space Allowance for Gilts and Sows in Group Housing", Appendix C "Floor Space Allowances for Weaned/Nursery Pigs", Appendix D "Floor Space Allowances for Grower/Finisher Pigs", Appendix E "Recommended Minimum Space Allowances for Boars" and Appendix N "Methods of Euthanasia";

             (f)  Code of Practice for the Care and Handling of Hatching Eggs, Breeders, Chickens and Turkeys, published by the National Farm Animal Care Council, including Appendix B "Methods of Euthanasia";

             (g)  Code of Practice for the Care and Handling of Pullets and Laying Hens, published by the National Farm Animal Care Council, including Appendix A "Transitional and Final Housing Requirements for Enriched Cages", Appendix B "Transitional and Final Housing Requirements for Non-Cage Housing" and Appendix E "Acceptable Methods of Euthanasia";

             (h)  Code of Practice for the Care and Handling of Bison, published by the National Farm Animal Care Council;

              (i)  Code of Practice for the Care and Handling of Equines, published by the National Farm Animal Care Council, including Appendix J "Technical Guidelines for Euthanasia Methods"; and

              (j)  Code of Practice for the Care and Handling of Rabbits, published by the National Farm Animal Care Council, including Appendix G "Methods of On-Farm Euthanasia".

             (2)  Subsection 4(2) of the regulations is amended by deleting the words "bison or horses" and substituting the words "bison, horses, ponies, miniature horses, donkeys, mules, hinnies or rabbits".

             (3)  Subsection 4(3) of the regulations is amended by deleting the words "bison or horses" and substituting the words “bison, horses, ponies, miniature horses, donkeys, mules, hinnies or rabbits".

 

 

        2. Section 6 of the regulations is repealed and the following substituted:

Kennels

        6. (1) A Code of Practice for Canadian Kennel Operations, published by the Canadian Veterinary Medical Association, is adopted except for

             (a)  the section entitled, "Transport"; and

             (b)  the appendices of the code.

             (2)  An owner or operator of a kennel shall comply with the requirements in A Code of Practice for Canadian Kennel Operations to the extent that they are adopted under subsection (1).

 

        3. Section 11 of the regulations is repealed and the following substituted:

Circuses

      11. (1) The CAZA Accreditation Standards, published by Canada's Accredited Zoos and Aquariums, is adopted.

             (2)  An owner or operator of a circus shall comply with the requirements in the CAZA Accreditation Standards that are adopted under subsection (1).

             (3)  Upon the request of an inspector, the owner or operator of a circus shall provide the inspector with a written record

             (a)  listing the species of animals kept, used, handled and displayed in relation to the circus;

             (b)  describing their housing conditions; and

             (c)  describing the acts they are to perform in the province.

 

        4. Schedule A of the regulations is repealed and the following substituted:
