Repeal Schedule A Schedule B Short title 1. This Notice may be cited as the Department of Education and Early Childhood Development Notice. Definitions 2. In this Notice (a) "department" means, unless the context indicates otherwise, the Department of Education and Early Childhood Development; and (b) "minister" means, unless the context indicates otherwise, the Minister of Education and Early Childhood Development. Departmental 3. (1) The department was confirmed by Order in Council 2017-027. (2) The department is presided over by the minister. (3) The department has 2 branches, as follows: (a) Corporate and School Infrastructure; and (b) Kindergarten to Grade 12 Education and Early Childhood Development. Powers and duties of the minister 4. The powers, functions and duties of the minister include the supervision, control and direction of all matters relating to (a) child care services; (b) early childhood learning; (c) public libraries; and (d) primary, elementary and secondary education, including: (i) schools, school districts and educational agencies receiving financial aid directly or indirectly from the province, (ii) transportation of students to and from school, (iii) provincial curriculum and programs, including supports for students with exceptionalities, (iv) high school certification and provincial assessments, (v) monitoring performance and ensuring progress of schools, (vi) regulation of private primary, elementary and secondary schools, (vii) home instruction, (viii) teacher certification, and (ix) international educational services, which are not, or in so far as they are not, the responsibility of another minister, agency, body, corporation, board, organization or person. Administration of Acts 5. (1) The minister has sole responsibility for the administration of the Acts set out in Schedule A and of all orders and regulations passed or made under those Acts, including those powers, functions or duties necessary or desirable for carrying out the purposes of those Acts. (2) The minister and the minister of the department indicated in Schedule B share responsibility for the administration of the Act set out in Schedule B and of the orders and regulations passed or made under that Act, including those powers, functions or duties necessary or desirable for carrying out the purposes of that Act. (3) The minister has primary responsibility for the administration of the Act set out in Schedule B. Repeal 6. The Department of Education Notice, 2003, Newfoundland and Labrador Regulation 75/03, is repealed. Schedule A 1. Public Libraries Act 2. Schools Act, 1997 3. Teacher Training Act 4.
