Repeal Schedule A Schedule B Schedule C Short title 1. This Notice may be cited as the Department of Municipal Affairs and Environment Notice. Definitions 2. In this Notice (a) "department" means, unless the context indicates otherwise, the Department of Municipal Affairs and Environment; and (b) "minister" means, unless the context indicates otherwise, the Minister of Municipal Affairs and Environment. Departmental structure 3. (1) The department was restructured by Order in Council 2017-254. (2) The department is presided over by the minister. (3) The department consists of 4 branches, as follows: (a) Environment; (b) Fire, Emergency and Corporate Services; (c) Municipal Infrastructure and Support; and (d) Climate Change. Registrar General 4. (1) The minister is appointed the Registrar General under subsection 4(2) of the Executive Council Act. (2) The minister has the powers, duties and functions of the Registrar General under subsection 4(3) of the Executive Council Act. Powers and duties of the minister 5. The powers, functions and duties of the minister include the supervision, control and direction of all matters relating to (a) provincial affairs; (b) municipal affairs; (c) the provision of emergency services; (d) the provision of fire protection services; (e) the protection, enhancement and conservation of the quality of the natural environment, including water, air and soil quality; (f) environmental assessment; (g) the conservation, development, control, improvement and proper utilization of the water resources of the province; (h) policy
development, as well as coordination and monitoring of implementation
activities for climate change, adaptation and mitigation measures; (i) the
regulation, mitigation and control of measures related to the reduction of
greenhouse gas emissions, as defined in the Management of Greenhouse Gas Act;
and (j) policy development, as well as coordination and monitoring of implementation activities, for energy efficiency, which are not, or in so far as they are not, the responsibility of another minister, agency, body, corporation, board, organization or person. Administration of Acts 6. (1) The minister has sole responsibility for the administration of the Acts set out in Schedule A and of all orders and regulations passed or made under those Acts, including those powers, functions or duties necessary or desirable for carrying out the purposes of those Acts. (2) The minister and the minister of the departments indicated in Schedules B and C share responsibility for the administration of the Acts set out in Schedules B and C and of the orders and regulations passed or made under those Acts, including those powers, functions or duties necessary or desirable for carrying out the purposes of those Acts. (3) The minister has primary responsibility for the administration of the Acts set out in Schedule B and secondary responsibility for the administration of the Acts set out in Schedule C. Repeal 7.
