Milk Regulations, 1998 (Amendment)
under the
Milk Scheme, 1998
and the
Natural Products Marketing Act

Under the authority of section 8 of the Milk Scheme, 1998 and the Natural Products Marketing Act, the Dairy Farmers of Newfoundland and Labrador make the following regulations.

        1. Paragraph 26(b) of the Milk Regulations, 1998 is repealed and the following substituted:

             (b)  $0.028 per litre on all milk originally produced on dairy farms situated outside the province and marketed under the Milk Scheme, 1998, payable by the owner at the time of its entry in the province.

 

        2. Section 28 of the regulations is repealed and the following substituted:

      28. (1) The DFNL may issue to a processor, for a limited period of time, a licence to import, distribute and market milk.

             (2)  A person shall not bring any milk into the province unless the person holds a valid licence for the importation of milk issued by the DFNL under subsection (1).

             (3)  Unless an exemption is made by the DFNL, separate permit numbers shall be obtained for each shipment of milk outside the province.

             (4)  A person holding a licence issued under subsection (1) shall not import pre-packaged milk into the province in an amount greater than 3 percent of the amount that person processes or produces within the province in any given month or each month.

             (5)  Any person who contravenes subsection (4) is liable to either or both of the following penalties:

             (a)  a penalty per litre over the permitted amount of pre-packaged milk equal to the difference between the export price of milk determined under subsection 24(1) and the minimum price for milk under section 22; or

             (b)  a suspension of the licence issued under subsection (1). 

 

        3. Section 29 of the regulations is repealed.

 

        4. Section 31 of the regulations is repealed.
