Animal Protection Standards Regulations (Amendment)
under the
Animal Health and Protection Act

(Filed August 7,2025)

Under the authority of subsections 29(2) and 66(4) of the Animal Health and Protection Act, I make the following regulations.

        1. (1) Section 1 of Schedule A of the Animal Protection Standards Regulations is repealed and the following substituted:

 

        1. Code of Practice for the Care and Handling of Dairy Cattle (2023), published by the National Farm Animal Care Council.

             (2)  Section 2 of Schedule A of the regulations is repealed and the following substituted:

 

        2. Code of Practice for the Care and Handling of Farm Animals - Goats (2022), published by the National Farm Animal Care Council.

             (3)  Section 14 of Schedule A of the regulations is repealed and the following substituted:

 

      14. Code of Practice for the Care and Handling of Farmed Mink (2021), published by the National Farm Animal Care Council.

             (4)  Section 20 of Schedule A of the regulations is repealed and the following substituted:

 

      20. CCAC guidelines on: Laboratory Animal Facilities (2024), published by the Canadian Council on Animal Care.

 

        2. (1) Schedule B of the regulations is amended by repealing the heading “Tethering” and substituting the following:

Containment

             (2)  Section 30 of Schedule B of the regulations is repealed and the following substituted:

 

      30. (1) A dog that is safely contained outside shall be contained

             (a)  in a location that does not pose a high risk of injury or other distress to the dog; and

             (b)  in an environment that is free of debris and does not cause harm or undue strain or stress on the dog.

             (2)  A dog that is safely contained outside shall be provided with sufficient protection from the weather to prevent the dog from experiencing undue distress, taking into account the dog’s

             (a)  age;

             (b)  health;

             (c)  breed;

             (d)  coat; and

             (e)  ability to adapt to heat or cold.

             (3)  Schedule B of the regulations is amended by adding immediately after section 30 the following:

 

   30.1 A dog shall not be contained outside in extreme weather conditions identified by a weather watch or warning issued by Environment and Climate Change Canada.

             (4)  Section 31 of Schedule B of the regulations is repealed and the following substituted:

 

      31. The area in which a dog is contained, unsupervised, outside, shall

             (a)  provide sufficient space to ensure that the dog

                      (i)  can move freely and engage in natural behaviour, and

                     (ii)  is not required to sit, stand or lie down in excreta;

             (b)  have clean areas for feeding and drinking; and

             (c)  be cleaned and have excreta removed on a daily basis.

             (5)  Section 32 of Schedule B of the regulations is repealed and the following substituted:

 

      32. (1) A tether used to contain a dog outside shall

             (a)  be at least 5 times the length of the dog;

             (b)  allow the dog to move in a manner that is safe and unrestricted, excepted by its length; and

             (c)  not weigh more than 10 per cent of the dog's body weight.

             (2)  A collar or harness used with a tether on a dog contained outdoors shall be of a size, type, design and fit so as to not cause the dog discomfort or injury.

             (3)  The following collars or harnesses shall not be used with a tether as a restraining device on a dog contained outdoors:

             (a)  choke collar;

             (b)  pinch collar;

             (c)  prong collar;

             (d)  slip collar;

             (e)  head halter collar; or

             (f)  martingale collar.

             (4)  A dog shall not be kept contained while wearing a muzzle that impedes the dog's ability to breathe or drink water.

             (6)  Section 33 of Schedule B of the regulations is amended by deleting the word "tethered" and substituting the word "contained".

             (7)  Section 34 of Schedule B of the regulations is repealed and the following substituted:

 

      34. A dog shall not be contained, unsupervised, outside, where the dog is

             (a)  under 6 months of age;

             (b)  whelping;

             (c)  nursing;

             (d)  in estrus; or

             (e)  aged or infirm.

Commencement

        3. These regulations come into force on the day the Animal Health and Protection (Amendment) Act, SNL2024 c18, comes into force.
