Conflict of Interest Regulations
under the
Conflict of Interest Act
(O.C. 96‑996)

Under the authority of section 8 of the Conflict of Interest Act and the Subordinate Legislation Revision and Consolidation Act, the Lieutenant‑Governor in Council makes the following regulations.

Short title

        1. These regulations may be cited as the Conflict of Interest Regulations.

Definitions

        2. In these regulations

             (a)  "Act" means the Conflict of Interest Act; and

             (b)  "agency", "auditor general", "disclosure statement", "member" and "public employee" mean agency, auditor general, disclosure statement, member and public employee as defined by the Act.

Disclosure statement

        3. For the purpose of the Act a disclosure statement shall be in the prescribed form and all information contained in the statement shall be verified by affidavit signed by the person making the disclosure statement in the manner indicated in the form of affidavit forming a part of the disclosure statement.

Information in statement

        4. The information to be contained in the disclosure statement shall be set out in the manner and to the extent indicated by the form of disclosure statement.

Filing and inspection of statements

        5. Disclosure statements filed by members of the House of Assembly with the auditor general in accordance with the Act and these regulations are open to public inspection between the hours of 10:00 a.m. and noon and between the hours of 2:30 p.m. and 4:30 p.m. on every day during which the departments of government are open to the general public and that inspection may be made at the office of the auditor general.

Filing and inspection of statements

        6. Disclosure statements filed with the auditor general by public employees, as defined by the Act, and members, as defined by the Act, who are not members of the House of Assembly are open to inspection during government hours by a member of the House of Assembly or a person authorized by a minister of the Crown or the auditor general and that inspection may be made at the office of the auditor general.

Application for inspection

        7. A person desiring to inspect a disclosure statement filed in accordance with the Act shall, before that inspection, furnish for the records of the auditor general in the prescribed form.

Repeal

        8. The Conflict of Interest Regulations, 1973, Newfoundland Regulation 389/78, are repealed.
