Newfoundland Vegetable Marketing Board Licensing Regulations
under the
Newfoundland Vegetable Marketing Scheme
and
Natural Products Marketing Act
(O.C. 96‑940)

Under the authority of paragraph 5(1)(f) of the Newfoundland Vegetable Marketing Scheme, the Natural Products Marketing Act and the Subordinate Legislation Revision and Consolidation Act, the Lieutenant‑Governor in Council makes the following regulations.

Short title

        1. These regulations may be cited as the Newfoundland Vegetable Marketing Board Licensing Regulations.

Marketing

        2. A producer shall not engage in the marketing of regulated products in the province unless the person is the holder of a valid licence issued by the board and pays to the board annually a fee as prescribed by the minister.

Processing

        3. A person or company shall not engage in the processing of regulated products in the province unless the person or company is the holder of a valid licence issued by the board and pays to the commodity board annually a fee as prescribed by the minister.

Wholesale, distribution or marketing

        4. A person or company shall not engage in the wholesaling, distribution or marketing of regulated products in the province unless the person or company is the holder of a valid licence issued by the commodity board and pays to the commodity board annually a fee as prescribed by the minister.

Expiry of licence

        5. Every licence shall expire on June 30 of the year for which it was issued.

Monthly report

        6. Every licensee shall report on a monthly basis to the commodity board the amount of regulated products which were marketed by that person or company in the previous month.

Compliance required

        7. The licensee shall comply with all orders and regulations of the commodity board.

Licence refusal, suspension or revocation

        8. The commodity board may refuse to issue or renew a licence, may suspend or revoke a licence where the applicant or licensee has failed to observe, perform or carry out any conditions of the licence.

Licence to be returned

        9. A licensee who ceases to be a producer, processor or wholesaler shall return the licence to the commodity board not later than one month from the date on which that person or company ceased to be a producer, processor or wholesaler.

Licences non‑transferable

     10. Licences issued by the commodity board are not transferrable.

Review of regulations

     11. The commodity board may review these regulations at a regular meeting of the board to determine whether or not any changes or modifications are required.

Repeal

      12. The Newfoundland Vegetable Marketing Board Licensing Regulations, 1984, Newfoundland Regulation 44/84, are repealed.
