CHAPTER 46

AN ACT TO AMEND THE URBAN AND RURAL PLANNING ACT

(Assented to December 11, 1991)

Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows:

1. Paragraph 13(1)(b) of The Urban and Rural Planning Act is repealed and the following substituted:

(b) authorize the council concerned to exercise interim control over development within the municipal planning area.

(2) Section 13 of the Act is further amended by adding immediately after subsection (1) the following:

(1.1) An interim development order made under paragraph (1)(b) shall continue in force

(a) until the land use zoning and subdivision regulations referred to in section 37 are brought into force under section 40; or

(b) for no longer than 5 years from the date on which the interim development order is published in the Gazette.

(1.2) Notwithstanding subsection (1.1), an interim development order may be renewed for further periods of no longer than 5 years and each renewal order shall be made in the same manner that an order is made under paragraph (1)(b).
