CHAPTER 42

AN ACT TO AMEND THE OCCUPATIONAL HEALTH AND SAFETY ACT

(Assented to December 23, 1992)

Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows:

1. Section 67 of the Occupational Health and Safety Act, is repealed and the following substituted:

Offences

67. (1) A person who

(a) contravenes this Act or the regulations;

(b) fails to comply with an order made under this Act or the regulations; or

(c) fails to follow a code of practice adopted under section 36,

is guilty of an offence and is liable on summary conviction to a fine not exceeding $50,000 or to a term of imprisonment not exceeding 6 months or to both a fine and imprisonment.

(2) In addition to a fine imposed under subsection (1) the court may impose a fine not exceeding $5,000 for each day during which the offence continues.
