AN ACT TO AMEND THE PROVINCIAL PARKS ACT
(Assented to June 18, 1996)

Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows:

1. The Provincial Parks Act is amended by adding immediately after section 9 the following:

10. (1) A user of the Newfoundland T'Railway Park voluntarily assumes all risks that may be encountered on the land included in the Newfoundland T'Railway Park when using the Newfoundland T'Railway Park, whether or not the person is within the Newfoundland T'Railway Park.

(2) The Crown, as an owner or occupier of land included in the Newfoundland T'Railway Park, together with the agents, employees or servants of the Crown, does not owe a duty of care towards a person who is using the Newfoundland T'Railway Park or that person's property whether or not the person is within the Newfoundland T'Railway Park.
