INFORMATION ACT AND THE PRIVACY ACT

Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows:

FREEDOM OF INFORMATION ACT

1. Subsection 10(2) of the Freedom of Information Act is amended by deleting the word "and" at the end of paragraph (d), by deleting the period at the end of paragraph (e) and substituting a semicolon and the word "and" and by inserting immediately after that paragraph the following:

(f) information regarding the criminal history of an individual which, in the opinion of the minister or his or her designate, it is in the public interest to disclose.

2. The Privacy Act is amended by adding the following immediately after section 12:

13. No action lies against the minister or his or her designate under this Act as a result of the disclosure of information regarding the criminal history of a person which, in the opinion of the minister or his or her designate, it is in the public interest to disclose.
