CHAPTER 24

AN ACT TO AMEND THE AQUACULTURE ACT

(Assented to December 15, 1998)

Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows:

1. (1) Subsection 4(3) of the Aquaculture Act is amended by adding immediately after paragraph (d) the following:

(d.1) contain terms and conditions relating to access to a site, optimal resource utilization and health, safety and the environment;

(2) Paragraph 4(5)(a) of the Act is repealed and the following substituted:

(a) incorporate into the licence a plan relating to

(i) health, safety and environmental matters, and

(ii) resource utilization and sustainable development;

2. Paragraphs 11(a), (j) and (x) of the Act are repealed.

3. The Act is amended by adding immediately after section 11.1 the following:

Regulations

11.2 The minister may make regulations

(a) respecting optimal resource utilization and sustainable development;

(b) respecting maters related to health, safety and the protection of the environment;

(c) prescribing the marking of aquaculture gear, of the boundaries of a site and any other markings or identification; and

(d) respecting the use, or prohibiting the use, of chemicals, fertilizers, vaccines, drugs, feed, and other substances in the conduct of aquaculture.
