Statutes of Newfoundland 1999 CHAPTER 41 AN ACT TO AMEND THE WORKS, SERVICES AND TRANSPORTATION ACT (Assented to December 14, 1999) Analysis 1. S.35 Amdt. 2. Commencement Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows: SN1995 cW-12 1. Subsection 35(8) of the Works, Services and Transportation Act is repealed and the following substituted: (8) A person who contravenes (a) the regulations referred to in this section; (b) a condition attached to or prescribed in respect of a permit issued under subsection (4); or (c) a direction of the minister referred to in subsection (5), is guilty of an offence and liable to the penalty provided for in the regulations. (8.1) Every continuation for an hour of a contravention under subsection (8) constitutes a separate offence where this is specified on the sign erected or on the permit or in the direction issued under subsections (4), (5) and (7). (8.2) A second or subsequent offence may occur on the same day or after and the appropriate penalty shall apply even if the convictions for the first and second or subsequent offence are entered on the same day.
