CHAPTER 40

AN ACT TO AMEND THE
HIGHWAY TRAFFIC ACT NO. 3

Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows:

        1. Subsection 65(1.1) of the Highway Traffic Act is repealed and the following substituted:

         (1.1)  Notwithstanding subsection (1), the registrar shall by written order suspend or cancel the driver's licence or driving privileges of a person who has been convicted of an offence committed anywhere in Canada

             (a)  under subsection 255(2), (2.1) or (2.2) of the Criminal Code, for a period of 10 years; or

             (b)  under subsection 255(3), (3.1) or (3.2) of the Criminal Code, for life.

 

        2. Subsection 81(2) of the Act is repealed and the following substituted:

             (2)  Where a driver's licence or vehicle licence is suspended under subsection (1), the licence shall remain suspended and shall not afterward be renewed, nor shall a driver's licence or vehicle licence be afterward issued to that person, until the judgment referred to in subsection (1) is satisfied or discharged to the extent to which financial responsibility is required to be given under section 76, and until that person gives proof of his or her financial responsibility.
