Teacher Certification Regulations
under the
Teacher Training Act
(O.C. 96-941)

Under the authority of section 11 of the Teacher Training Act and the Subordinate Legislation Revision and Consolidation Act , the Lieutenant-Governor in Council makes the following regulations.

Short title

        1. These regulations may be cited as the Teacher Certification Regulations.

Interpretation

        2. (1) In these regulations

             (a)  "Act" means the Teacher Training Act ;

             (b)  "additional course" means a credited course that is additional to those courses in respect of which a degree or a diploma has been conferred on an applicant for a certificate or licence;

             (c)  "approved " means approved by the committee;

             (d)  "approved subject area" means the area of art, home economics, industrial arts, music or another area that may be approved by the committee;

             (e)  "certificate " means a certificate issued under these regulations;

             (f)  "committee " has the meaning assigned to it by the Act;

             (g)  "course" means, except in paragraph (i.1), a course of study at Memorial University or a course of study at another recognized educational institution that, in the opinion of the registrar, is equivalent to a course of Memorial University;

             (h)  "course in education" means a course of studies at a recognized educational institution listed under education at that institution;

              (i )  "director " means a director appointed under section 110 of the Schools Act, 1997;

           (i.1)  "full time student" means a student enrolled in a minimum of 4 courses during a term or another minimum number of courses satisfactory to the registrar;

              (j)  "initial certificate" means a certificate issued under subsections 3(1) and (2);

             (k)  "integrated program of studies" means a structured course of study which has the prior approval of the registrar in accordance with policies which have been approved by the committee;

              (l)  "interim certificate" means a certificate issued under section 16;

           (m)  "licence " means a teaching licence issued under these regulations;

        (m.1)  "post secondary studies" means studies at the College of the North Atlantic or at another educational institution that, in the opinion of the registrar, is equivalent to the College of the North Atlantic ;

             (n)  "recognized educational institution" means an institution specified in or designated under section 17 of the Act;

             (o)  "school year" has the meaning assigned to it by the Schools Act, 1997;

             (p)  "student-teaching practicum" means a student teaching practicum of not less than 4 semester courses at Memorial University or a practicum of another recognized educational institution that in the opinion of the registrar is equivalent to a practicum of Memorial University, or a period of not less than 2 years of successful teaching experience as approved by the registrar; and

             (q)  "superintendent " means a superintendent of schools appointed under section 51.7 of the Schools Act, 1997 .

             (2)  Unless the context otherwise requires, a reference to a degree or a diploma means a degree or a diploma awarded by Memorial University, or a degree or a diploma awarded by, or evidence satisfactory to the registrar of successful completion of a program of, another recognized educational institution that, in the opinion of the registrar, is equivalent to a degree or a diploma awarded by Memorial University.

Initial certificate or licence

        3. (1) An applicant for an initial certificate or a teaching licence shall submit

             (a)  an application on the form provided for the purpose by the registrar;

             (b)  a birth certificate;

             (c)  official transcripts, or other evidence that the registrar may require, of the academic and professional qualifications of the applicant;

             (d)  for non-resident applicants the evidence that the registrar may require that the applicant has completed studies on a teacher education program leading to certification in his or her province or country and proof of a valid teaching certificate where applicable;

             (e)  where required, evidence of Canadian citizenship, landed immigrant status, or equivalent;

             (f)  where required, results of an approved English proficiency test; and

             (g)  a Teacher Certification Confidential Disclosure Form provided for the purpose by the registrar.

             (3)  An applicant for a certificate or a licence other than described in subsection (1) shall submit

             (a)  an application on the form provided for the purpose by the registrar; and

             (b)  official transcripts, or other evidence that the registrar may require, of the academic and professional qualifications of the applicant.

Certificate and licence

        4. (1) A certificate that is endorsed "Secondary Education Teaching Certificate" identifies the holder of the document as having the professional qualifications to teach all secondary school grades.

             (2)  A certificate that is endorsed "Primary/Elementary Education Teaching Certificate" identifies the holder of the document as having the professional qualifications to teach all primary or elementary school grades.

             (3)  A certificate that is endorsed "Primary/Elementary/Secondary Teaching Certificate" identifies the holder of the document as having the professional qualifications to teach all primary, elementary and secondary school grades.

             (4)  A Licence I permits the holder to teach all primary, elementary or secondary grades.

Certificates II and III

        5. (1) A certificate classified as a Certificate II may be issued to an applicant who holds a certificate classified and issued under previous regulations as a Certificate I and is credited with 20 courses on a program of studies leading to a degree in education and of which not less than 4 courses are in education and 2 courses are in english.

             (2)  Notwithstanding subsection (1), a certificate classified as a Certificate II may be issued to an applicant who has completed the diploma in native and northern education in Labrador .

             (3)  A certificate classified as a Certificate III may be issued to an applicant who holds a certificate classified and issued under these or previous regulations as a Certificate II and

             (a)  is credited with 30 courses on a program of studies leading to a degree in education and of which not less than 6 courses are in education and 2 courses are in english; or

             (b)  has completed the diploma in native and northern education in Labrador and who has completed 10 additional courses in a program of studies leading to a degree in education.

             (4)  A certificate issued under subsection (1), (2) or (3) permits the holder to teach all primary, elementary or secondary school grades.

Certificate IV

        6. (1) A certificate classified as a Certificate IV and endorsed "Secondary Education Teaching Certificate" may be issued to an applicant

             (a)  who is credited with either 40 courses leading to a degree in other than primary/elementary education, and of which not less than

                      (i)  2 are courses in english ,

                     (ii)  18 are courses in subjects taught in schools in the province,

                    (iii)  10 are courses in secondary education, including successful completion of a student-teaching practicum; and

             (b)  whose additional courses are within his or her degree program; or

             (c)  who holds an approved education degree.

             (2)  A certificate classified as a Certificate IV and endorsed "Primary/Elementary Education Teaching Certificate" may be issued to a candidate

             (a)  who is credited with 40 courses leading to a degree in primary or elementary education, and of which not less than

                      (i)  2 are courses in english ,

                     (ii)  10 are courses in subject areas taught in the schools of the province,

                    (iii)  18 are courses in primary or elementary education;

             (b)  who has successfully completed a student-teaching practicum; and

             (c)  whose additional courses are within the requirements of the primary or elementary degree program; or

             (d)  who holds an approved education degree.

             (3)  A certificate classified as a Certificate IV and endorsed "Primary/Elementary/Secondary Education Teaching Certificate" may be issued to an applicant whose qualifications meet the requirements for the issue of a certificate under subsections (1) and (2).

             (4)  Notwithstanding subsections (1), (2) and (3), all applicants to whom certificates are issued after December 31, 1994 must hold an approved education degree.

Certificate V

        7. (1) A teaching certificate classified as a Certificate V may be issued to an applicant

             (a)  whose qualifications meet the requirements for the issue of a Certificate IV under subsection 6(1), (2) or (3);

             (b)  who has 50 credited courses;

             (c)  who holds a degree; and

             (d)  whose additional courses shall comprise an integrated program of studies.

             (2)  Where the qualifications of the applicant meet the requirements for the issue of a Certificate IV under subsection 6(1), the Certificate V shall be endorsed "Secondary Education Teaching Certificate".

             (3)  Where the qualifications of the applicant meet the requirements for the issue of a Certificate IV under subsection 6(2), the Certificate V shall be endorsed "Primary/Elementary Teaching Certificate".

             (4)  Where the qualifications of the applicant meet the requirements for the issue of a Certificate IV under subsection 6(3), the Certificate V shall be endorsed "Primary/Elementary/Secondary Teaching Certificate".

Certificate VI

        8. (1) A teaching certificate classified as a Certificate VI may be issued to an applicant

             (a)  whose qualifications meet the requirements for the issue of a Certificate V;

             (b)  who has 60 credited courses; and

             (c)  who has completed a 50 credit course program which resulted in one degree and has completed an integrated program of studies or a second degree or an approved diploma equivalent to a degree;

             (d)  who has completed a 50 credit course program which resulted in a conjoint degree or equivalent degrees and has completed an integrated program of studies or a third degree or an approved diploma equivalent to a degree;

             (e)  who has completed a 40 course program which resulted in one degree and a 20 course program which resulted in a second degree or approved diploma equivalent to a degree; or

             (f)  who has completed 3 sessions of a Three Session Specialist Course which resulted in a subject specialist qualification on his or her record card or record of qualification under the Teachers' Qualification Regulations existing under the Education Act (Ontario ).

             (2)  Where the qualifications of the applicant meet the requirements for the issue of a Certificate IV under subsection 6(1), the Certificate VI shall be endorsed "Secondary Education Teaching Certificate".

             (3)  Where the qualifications of the applicant meet the requirements for the issue of a Certificate IV under subsection 6(2), the Certificate VI shall be endorsed "Primary/Elementary Teaching Certificate".

             (4)  Where the qualifications of the applicant meet the requirements for the issue of a Certificate IV under subsection 6(3), the Certificate VI shall be endorsed "Primary/Elementary/Secondary Teaching Certificate".

Certificate VII

        9. (1) A certificate classified as a Certificate VII may be issued to an applicant

             (a)  whose qualifications meet the requirements for the issue of a Certificate VI;

             (b)  who has 70 credited courses;

             (c)  who holds an approved Master's or Doctorate degree; and

             (d)  whose additional courses shall comprise an integrated program of studies.

             (2)  Where the qualifications of the applicant meet the requirements for the issue of a Certificate IV under subsection 6(1), the Certificate VII shall be endorsed "Secondary Education Teaching Certificate".

             (3)  Where the qualifications of the applicant meet the requirements for the issue of a Certificate IV under subsection 6(2), the Certificate VII shall be endorsed "Primary/Elementary Teaching Certificate".

             (4)  Where the qualifications of the applicant meet the requirements for the issue of a Certificate IV under subsection 6(3), the Certificate VII shall be endorsed "Primary/Elementary/Secondary Teaching Certificate".

Upgrading compliance

      9.1 A teacher who wishes to acquire qualifications in order to qualify for a higher classification of teaching certificate or licence under the Act and these regulations shall comply with the requirements of the schedule attached to these regulations.

Emergency Supply Licence

      10. (1) A teaching licence classified as an Emergency Supply Licence may on the recommendation of a director or a superintendent be issued to an applicant who has completed provincial high school matriculation or the equivalent of provincial high school matriculation as determined by the registrar.

             (2)  A teaching licence issued under subsection (1) shall be valid to the end of the school year for which it is issued.

Licence III

      11. (1) A teaching licence classified as a Licence III may on the recommendation of a director or a superintendent be issued to an applicant who holds not less than a 3 year university degree or equivalent as approved by the registrar.

             (2)  A teaching licence issued under subsection (1) shall only be issued upon the verification by a director or a superintendent that the licence holder will be employed in a position for which there is no other qualified and certified teacher available.

             (3)  A teaching licence issued under subsection (1) is valid only for the school year in which it is issued and may be re-issued annually.

Speech language pathologists

      14. (1) A level VI certificate, endorsed "Speech Language Pathologist" may be issued to an applicant who has completed an approved Master's degree in speech-language pathology and who is a speech language pathologist registered under section 19 of the Health Professions Act .

             (2)  A level VII certificate, endorsed "Speech Language Pathologist" may be issued to an applicant who has satisfied the requirements of subsection (1) and has completed 8 additional graduate courses approved by the registrar or has completed an approved doctoral degree program.

Educational psychologists

   14.1 A level VI certificate, endorsed "Educational Psychologist" may be issued to an applicant who has completed a Master's degree and who is a psychologist registered under section 10 of the Psychologists Act, 2005 .

Teaching and learning assistant

   14.2 (1) A level II certificate endorsed "Teaching and Learning Assistant" may be issued to an applicant who

             (a)  has 20 credited courses satisfactory to the committee; or

             (b)  has completed, as a full time student, a minimum of 2 years post secondary studies satisfactory to the committee.

             (2)  A person who was issued a certificate under section 5, 6, 7, 8 or 9 may be employed as a teaching and learning assistant and shall not be required to apply for a certificate referred to in subsection (1).

Reciprocal agreements

      15. (1) A teaching certificate classified as Certificate IV may be issued to an applicant who does not meet the criteria in section 6 where the applicant holds a valid teaching certificate from a Canadian jurisdiction that is a party to the Canadian Free Trade Agreement.

             (2)  Eligibility for a teaching certificate classified as Certificates V, VI and VII will be determined on the basis of the criteria in sections 7, 8 and 9.

             (3)  Notwithstanding section 16, the certificates referred to in subsections (1) and (2) may provide for expiry on a specified date if the applicant does not meet conditions specified by the registrar.

             (4)  A teaching certificate issued under subsection (1) or (2) may not be exchanged for a permanent certificate under section 16 until the applicant has complied with the conditions, if any, specified by the registrar under subsection (3).

             (5)  A copy of the Canadian Free Trade Agreement is on file with the registrar and may be examined or obtained during regular business hours.

Interim certificates

      16. All initial certificates awarded under these regulations shall be valid

             (a)  for an initial period of teaching of 2 school years; or

             (b)  for a further period of teaching, not to exceed 2 school years, as approved by the committee upon the written request of the director or the superintendent, and

may after that period be exchanged for a permanent certificate upon the recommendation of the director, the superintendent or an authorized person representing an approved educational institution in which the teacher is employed .

Certificate and permit continuation

      17. All certificates and permits issued under teacher certification regulations in force within the province, and not previously cancelled before the teacher certification regulations under which they were issued ceased to have effect, shall, whether or not the person holding the certificate or permit continued to teach, be considered to be valid and effective as if they had been issued under these regulations as certificates or licences, subject to the requirement that

             (a)  in relation to all certificates and permits, the grade of certificate or permit issued and held shall be considered to be of the same number or level as a certificate or licence issued under these regulations;

             (b)  upon application for higher certification, the applicant shall be subject to the existing regulations pertaining to the issue of certificates or licences.

Fees

      18. The fees for teacher certification shall be prescribed by the committee.

Repeal

      19. The Teacher (Certification) Regulations, 1988, Newfoundland Regulation 41/88, are repealed.

Schedule

Integrated Program of Study

Guidelines

Proposal submission

        1. Teachers proposing to complete an integrated program of study in accordance with paragraph 2(k) shall submit their program proposal to the registrar 3 months before commencement of studies.

Integrated program

        2. An integrated program shall comprise studies of a pedagogical or academic nature which, in the opinion of the registrar, contributes to the competency of the individual as a teacher.

Course of studies

        3. (1) Ten undergraduate or 8 graduate courses shall be approved by the registrar as one year of study.

             (2)  A thesis or a component of work certified equal to a thesis shall be credited as one-half year of study, except where otherwise indicated.

        4. Courses within a program must be related.

Credit of integrated program

        5. An integrated program may be credited for the awarding of Level V, VI or VII certificate, where

             (a)  Level V studies are completed at either the graduate or undergraduate levels;

             (b)  Level VI studies comprise not less than one-half the program in graduate courses;

             (c)  Level VII studies are completed at the graduate or post-graduate levels only.

Continuation of approved programs

        6. Programs of study or course patterns approved by the registrar before commencement of these regulations for the purpose of upgrading existing certificates or permits shall be considered valid and dealt with as if approved under these regulations.
