EXPLANATORY NOTE The purpose of this Bill is to amend the Municipalities Act, 1999 to add a provision that would allow the minister to direct the manner in which taxes are to be harmonized when 2 or more towns or areas are amalgamated or annexed. S.11.1 Added Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows: SNL1999 cM-24 1. The Municipalities Act, 1999 is amended by adding immediately after section 11 the following: Taxes upon amalgamation 11.1 (1) Notwithstanding that a town has imposed taxes and tax rates under Part V, where an order is made under paragraph 3(1)(b) to amalgamate that town or annex an area to that town, the minister may, in writing, direct the (a) manner in which taxes and tax rates applicable to the amalgamating towns and annexed areas are to be harmonized; and (b) time by which the harmonization referred to in paragraph (a) is to be carried out. (2) A direction of the minister under subsection (1) is binding upon the amalgamated towns and annexed areas to which it applies. ŠEarl G. Tucker, Queen's Printer |
