EXPLANATORY NOTES

This Bill would amend the Works, Services and Transportation Act to

·         allow the Lieutenant-Governor in Council to make regulations relating to the installation, maintenance and removal of signs on, over or adjacent to provincial highways; and

·         give the minister the authority to establish fees and forms for the purpose and administration of the Act.

Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows:

        1. Section 32 of the Works, Services and Transportation Act is repealed and the following substituted:

Advertising signs

      32. (1) A person shall not install or maintain a sign for the purposes of advertisement, announcement or direction within the control lines established under the regulations.

             (2)  Notwithstanding subsection (1), a sign may be installed and maintained in accordance with the regulations.

 

        2. Subsection 59(1) of the Act is amended by adding the following immediately after paragraph (a):

          (a.1)  providing for the installation, maintenance and removal of signs on, over or adjacent to provincial highways;

 

        3. The Act is amended by adding immediately after section 67 the following:

Fees and forms

      68. The minister may set fees and establish forms for the purpose and administration of this Act.

Commencement

        4. This Act comes into force on a day to be proclaimed by the Lieutenant-Governor in Council.
