EXPLANATORY NOTE

This Bill would amend the House of Assembly Accountability, Integrity and Administration Act to give effect to the Members' Compensation Review Committee recommendations approved on February 27, 2017.

AN ACT TO AMEND THE HOUSE OF ASSEMBLY ACCOUNTABILITY, INTEGRITY AND ADMINISTRATION ACT

Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows:

        1. Section 11 of the House of Assembly Accountability, Integrity and Administration Act is amended by adding immediately after subsection (1) the following:

         (1.1)  Notwithstanding subsection (1), a member's annual salary shall be adjusted by a percentage that is an average of the percentage salary adjustment under each of the following collective agreements:

             (a)  the General Service Collective Agreement;

             (b)  the Health Professionals Collective Agreement;

             (c)  the Registered Nurses' Union of Newfoundland and Labrador Collective Agreement; and

             (d)  the Royal Newfoundland Constabulary Collective Agreement.

         (1.2)  The adjustment referred to in subsection (1.1) shall be applied

             (a)  first, within 30 days after the date that the last of the agreements referred to in subsection (1.1) is finalized after the coming into force of that subsection; and

             (b)  after that, within 30 days after the date that the last of the collective agreements referred to in subsection (1.1) is finalized from time to time.

         (1.3)  A member's annual salary adjusted under subsection (1.1) shall be paid in 26 equal instalments, in arrears.

 

        2. Section 12 of the Act is repealed and the following substituted:

Other remuneration

      12. (1) A member who holds one of the following positions shall be paid an additional salary as follows:

             (a)  speaker, $48,665;

             (b)  deputy speaker and chair of committees $12,166;

             (c)  leader of the official opposition, $48,665;

             (d)  official opposition house leader, $24,330;

             (e)  leader of a third party, $24,330;

             (f)  third party house leader, $12,166;

             (g)  chairperson of the public accounts committee, $12,166; and

             (h)  vice chairperson of the public accounts committee, $9,300.

             (2)  The salaries referred to in subsection (1) shall be payable in 26 equal instalments, in arrears.

             (3)  A member who sits on a committee of the House of Assembly, the commission or a committee of the commission, shall not be paid for attendance at meetings.

             (4)  A member who sits on a committee of the House of Assembly, the commission or a committee of the commission may be reimbursed reasonable expenses in relation to attendance at meetings when the House is not in session.

             (5)  Where a member who holds a position referred to in paragraph (1)(a) or (b) is, due to illness or disability, absent and unable to carry out the duties of his or her position for a period of more than 10 consecutive sitting days of the House of Assembly,

             (a)  a member referred to in paragraph (1)(b) who carries out the duties of a member referred to in paragraph (1)(a); or

             (b)  another member appointed to carry out the duties of a member referred to in paragraph (1)(b),

is, after the expiration of those 10 days, and until the return to duties of the absent member or the appointment of a new member to the absent member's position, entitled to a salary referred to in subsection (1) for the position he or she replaces, without affecting the salary of the absent member.
