AN ACT FOR GRANTING TO HIS MAJESTY CERTAIN SUMS OF MONEY FOR DEFRAYING CERTAIN EXPENSES OF THE PUBLIC SERVICE FOR THE FINANCIAL YEAR ENDING MARCH 31, 2024 AND FOR OTHER PURPOSES RELATING TO THE PUBLIC SERVICE

MAY IT PLEASE YOUR MAJESTY-

                   WHEREAS it appears that the sums mentioned are required to defray certain expenses of the Public Service of Newfoundland and Labrador for the financial year ending March 31, 2024 and for other purposes relating to the public service:

MAY IT THEREFORE PLEASE YOUR MAJESTY THAT-

Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows:

Short title

        1. This Act may be cited as the Supply Act, 2023.

Further supply 2023-2024

        2. From and out of the Consolidated Revenue Fund there may be issued by the Minister of Finance and President of Treasury Board sums not exceeding $5,772,561,200 in addition to the sum of $2,974,162,700 authorized by the Interim Supply Act, 2023, the aggregate of the sums authorized to be issued under this Act and the Interim Supply Act, 2023 being $8,746,723,900.


 

Effect of authorizations

        3. The sums authorized to be issued by this Act as set out in the Schedule shall be paid and applied by the several Heads of Expenditure in respect of the financial year extending from April 1, 2023 to March 31, 2024 towards defraying the charges and expenses of the Public Service of Newfoundland and Labrador as set out in the Schedule.

Transfer of funds

        4. (1) Notwithstanding the Financial Administration Act, the Treasury Board may transfer sums voted within Consolidated Fund Services, 2.1.02 - Ex-Gratia and other Payments, to another Head of Expenditure during the fiscal year ending March 31, 2024, to facilitate expenditures for special retirement, salary, compensation and contract adjustments, employee benefits and other operating related payments.

             (2)   Notwithstanding the Financial Administration Act, the Treasury Board may transfer sums voted within Executive Council, 3.1.05 Financial Assistance - Current and 3.1.06 Financial Assistance – Capital, to another Head of Expenditure during the fiscal year ending March 31, 2024, to facilitate expenditures for current and capital financial assistance.

             (3)  Notwithstanding the Financial Administration Act, the Treasury Board may transfer sums voted within Consolidated Fund Services, 3.1.01 - Contingency, to another Head of Expenditure during the fiscal year ending March 31, 2024, to facilitate expenditures that have not been anticipated and not provided for by the Legislature.

             (4)  Notwithstanding the Financial Administration Act, the Treasury Board may transfer sums voted within the Department of Finance, 2.1.01 – Federal Programs, to another Head of Expenditure during the fiscal year ending March 31, 2024, to facilitate expenditures where funding has been provided by the federal government.

             (5)  Notwithstanding the Financial Administration Act, the Treasury Board may transfer sums voted within the Department of Education to another Head of Expenditure during the fiscal year ending March 31, 2024, to facilitate the integration of the Newfoundland and Labrador English School District into the provincial government.

             (6)  Notwithstanding the Financial Administration Act, the Treasury Board may transfer sums voted within various Heads of Expenditures to other Heads of Expenditure during the fiscal year ending March 31, 2024, to facilitate expenditures for disaster assistance recovery efforts.
