EXPLANATORY NOTES

This Bill would amend the Lands Act to

ˇ         allow the minister to charge a fee for the reservation of Crown Lands; and

ˇ         incorporate gender-neutral language.

Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows:

        1. (1) Paragraph 2(a) of the Lands Act is amended by deleting the words "the Trial Division of".

             (2)  Paragraph 2(e) of the Act is amended by deleting the words "Trial Division" and substituting the words "Supreme Court".

 

        2. Subsection 2.1(2) of the Act is amended by deleting the words "he or she" and substituting the words "the minister".

 

        3. (1) Subsection 7(6) of the Act is amended by deleting the words "his or her" wherever they appear and substituting the word "the".

             (2)  Subsection 7(8) of the Act is amended by deleting the words "he or she" and substituting the words "the minister".

 

        4. Section 8 of the Act is amended by adding immediately after subsection (2) the following:

         (2.1)  Where a reservation of Crown lands has been ordered under subsection (1) or (2), the minister may set fees for the purpose and administration of the reservation.

 

        5. Subsection 25(2) of the Act is amended by deleting the words "his or her" and substituting the words "the adverse claimant's".

 

        6. Section 27 of the Act is amended by deleting the words "he or she" and substituting the words "the adverse claimant".

 

        7. Paragraph 29.1(1)(d) of the Act is amended by deleting the words "he or she" and substituting the words "the person".

 

        8. Section 30 of the Act is amended by deleting the words "his or her" and substituting the words "the judge's".

 

        9. Subsection 59(4) of the Act is amended by deleting the words "his or her".

 

      10. Section 61 of the Act is amended by deleting the words "he or she" and substituting the words "the minister".

 

      11. (1) Subsection 64(2) of the Act is amended by deleting the words "his or her".

             (2)  Subsection 64(4) of the Act is amended by deleting the words "he or she acted under subsection (1), (2) or (3)" and substituting the words "the person acted under subsection (1) or the surveyor acted under subsection (2) or (3)".

             (3)  Subsection 64(5) of the Act is amended by deleting the words "him or her" and substituting the words "the person or surveyor".

 

      12. Subsection 65(1) of the Act is amended by deleting the words "his or her".
