EXPLANATORY NOTES

This Bill would amend the Memorial University Act to define "Newfoundland and Labrador resident" for the purposes of admission to the Faculty of Medicine or other prescribed faculties or schools of Memorial University.

Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows:

        1. The Memorial University Act is amended by adding immediately after section 68 the following:  

Newfoundland and Labrador resident

      69. (1) Notwithstanding paragraphs 34(1)(m) and 56(c) and other provisions in this Act related to admission to the university or a faculty or school of the university, where the Faculty of Medicine or another faculty or school of the university prescribed in the regulations reserves spaces for applicants who are Newfoundland and Labrador residents, only an applicant who meets the definition of Newfoundland and Labrador resident prescribed in subsection (2) shall be entitled to a space reserved for a Newfoundland and Labrador resident.

             (2)  For the purposes of subsection (1), "Newfoundland and Labrador resident" means a person who meets one or more of the following requirements:

             (a)  the person is a citizen or permanent resident of Canada and has completed, or is deemed by the Department of Education to have completed, 4 years of school between grade 7 and level III in the province no more than 12 years before the date of application to the faculty or school;

             (b)  the person is a citizen or permanent resident of Canada and the person's permanent address was located in the province for at least 3 years immediately before the date of application to the faculty or school; or

             (c)  other requirements that may be prescribed in the regulations.

             (3)  For the purposes of paragraph (2)(b), a person's permanent address is considered to be located in the province where

             (a)  the person physically resides in the province for at least 10 months a year and does not attend a post-secondary institution on a full-time or part-time basis; or

             (b)  the person resides in the province for less than 10 months a year but is employed in the province and the person physically resides within 100 kilometres of the person's employment and does not attend a post-secondary institution on a full-time or part-time basis.

Regulations

      70. The Lieutenant-Governor in Council may make regulations

             (a)  prescribing additional faculties or schools for the purposes of subsection 69(1);

             (b)  prescribing other requirements for the purposes of paragraph 69(2)(c); 

             (c)  defining a word or expression used but not defined in this Act; and

             (d)  generally, to give effect to the purpose of this Act.
