EXPLANATORY NOTES This Bill would amend the Workplace Health, Safety and Compensation Act, 2022 to ˇ add a definition of "temporary earnings loss benefits"; and ˇ modify the calculation of retirement benefits. S.85 Amdt. 3. Commencement Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows: SNL2022 cW-11.1 1. Subsection 2(1) of the Workplace Health, Safety and Compensation Act,
2022 is amended by adding
immediately after paragraph (hh) the following: (hh.1) "temporary earnings loss benefits"
means those benefits established
as temporary earnings loss benefits by a policy established by the board of
directors under subsection 7(1); 2. Subsection 85(1) of the Act is repealed and the following substituted: Retirement benefits 85. (1) Where a worker who is in receipt of extended
earnings loss benefits on or after January 1, 2019 in
respect of an injury reaches the age of 65 years, the worker is entitled to
receive a lump sum payment equal to (a) 5%
of the following benefits paid to the worker in respect of the injury, together
with accrued interest: (i) extended earnings loss benefits, and (ii) where the worker received temporary earnings loss benefits for more than 24 months, the temporary earnings loss benefits paid to the worker for the period in excess of 24 months; or (b) 10%
of the following benefits paid to the worker in respect of the injury, together
with accrued interest, where the worker is or was at the time of the injury a
member of an employer-sponsored pension plan: (i) extended earnings loss benefits, and (ii) where the worker received temporary earnings loss benefits for more than 24 months, the temporary earnings loss benefits paid to the worker for the period in excess of 24 months.
