Members-Elect met in the Assembly Chamber on the morning of October 27, 2011, for the Swearing-In Ceremony.

As Clerk of the House of Assembly, it gives me great pleasure to welcome His Honour the Administrator, all Members-Elect, and invited guests to this ceremony today. His Honour, the Lieutenant Governor, could not join us this morning and we are pleased to have Chief Justice Orsborn act as the Administrator in His Honour's stead.

Today, the Members-Elect gathered in this Chamber become Members of the House of Assembly for the Forty-Seventh General Assembly in our Province since 1833. On behalf of my fellow House Officers and all staff of the House of Assembly Service, I wish to state we look forward to working with and serving all members during this General Assembly.

A Proclamation has been issued by His Honour, the Lieutenant Governor, under the Great Seal of the Province. It reads as follows:

A PROCLAMATION

WHEREAS under section 128 of the Constitution Act, 1867, I, as Lieutenant Governor of the Province of Newfoundland and Labrador, am, or my delegate is, authorized to administer the Oaths or Affirmations of Allegiance to Her Majesty Queen Elizabeth II to those persons elected to be Members of the House of Assembly in the General Election held on October 11th, 2011;

AND WHEREAS under section 5 of the House of Assembly Accountability, Integrity and Administration Act, I, as Lieutenant Governor of the Province of Newfoundland and Labrador, am, or my delegate is, authorized to administer an Oath or Affirmation of Office to those persons elected to be Members of the House of Assembly in the said General Election;

AND WHEREAS a Proclamation has been issued to appoint the Honourable David B. Orsborn, Chief Justice of the Supreme Court, Trial Division, as Commissioner for the purpose of administering the Oath or Affirmation of Allegiance and Oath or Affirmation of Office in accordance with section 128 of the Constitution Act, 1867 and section 5 of the House of Assembly Accountability, Integrity and Administration Act;

AND WHEREAS the said sections of the Constitution Act, 1867 and the House of Assembly Accountability, Integrity and Administration Act further require that the persons declared elected as Members during the General Election held on the said date must take their Oaths or Affirmations of Allegiance and Oaths or Affirmations of Office before they can take their seats in the House of Assembly;

NOW THEREFORE, I, the Lieutenant Governor of the Province of Newfoundland and Labrador, do authorize and direct you, the said William MacKenzie and Elizabeth Murphy, or either of you, to request that the Members Elect gather in the House of Assembly Chamber on Thursday, October 27, 2011 at 10 o'clock in the morning in order to take their Oaths or Affirmations of Allegiance and Oaths or Affirmations of Office before the Honourable Commissioner."

Your Honour, I am pleased to report that Mr. Victor Powers, Chief Electoral Officer, has published a report in the October 27, 2011 edition of The Newfoundland and Labrador Gazette assuring us that forty-seven Members-Elect were duly elected on October 11, 2011. All are entitled to take their Oath or Affirmation of Allegiance and Oath or Affirmation of Office. The October 27, 2011 edition of The Newfoundland and Labrador Gazette containing the Report of the Chief Electoral Officer is deemed to be tabled and formerly entered into the House records.

It should be noted that the Writ of Election has not been returned from the District of Burin – Placentia West. There is currently an application before the Supreme Court with respect to the election in that district. Further, the Members-Elect for St. Barbe and St. John's North – I think that is all – are unavoidably absent today and will be sworn in at a later date.

To the ceremony: During the ceremony, each Member-Elect will be called in the alphabetical order in which his or her district is inscribed on the Roll of Members; that is the large, hand-lettered document lying here on the Table of the House near Ms Murphy. This signed Roll of Members is hung in the corridor outside the House when we are completed.

Members-Elect will come forward to this lectern here to His Honour's left. A Volume of Holy Scripture is there inside the lectern, and if you are taking your Oath you select one of the Volumes of Holy Scripture there. Each Member-Elect will swear an Oath of Allegiance or affirm allegiance to Her Majesty Queen Elizabeth the Second, as Queen of Canada, before His Honour. This requirement is set out in section 128 of the Constitution Act for members of all Legislatures in Canada.

Each Member-Elect will also make an Oath or Affirmation of Office. This is required under the House of Assembly Accountability, Integrity and Administration Act. For members, you will find the individual Oaths or Affirmations on each of your desks. You will find there are two copies of each. We ask that you bring all four copies forward, and after you have sworn your Oaths in front of His Honour you will move to the Table with the four copies.

The member will then move to the Table near Ms Murphy, sign the Members' Roll, and then sign the four copies of Oaths or Affirmations. We will keep one of each Oath for our records and you will retain one of each for your own records. Once all members have signed this Roll, His Honour, as well as the Clerk and Clerk Assistant, will witness it at the bottom. A facsimile of this Roll is prepared and then presented to members as a memento of the occasion.

Because of time constraints, we ask that you hold your applause until all Members-Elect have been sworn. Each Member-Elect may take about a minute, there are forty-five today, so there is probably at least forty-five minutes if we go quickly.

On behalf of His Honour, the Lieutenant Governor of Newfoundland and Labrador, may I congratulate you as you have accepted your individual and collective responsibilities as Members of the House of Assembly.

As you take your seats in this House, allow me to pass on the words of the Edward Roberts, Q.C., speaking as the Lieutenant Governor at the Swearing-in Ceremony in November 2003:

We are a democracy, a society where the ultimate authority rests with our fellow citizens, and you are the means by which those citizens exercise that ultimate authority. You are the link between them and the Crown. Your right to take the Oath to make the Affirmation was given to you by them through the ballot box. Further, it is you, the Members of the House of Assembly, who choose the government…

The Premier and her colleagues, the Queen's Ministers, exercise executive authority in the Queen's Name, but they answer to you. They are responsible to you. That is the way in which our citizens choose their government and that is what makes us a democracy.

If I may add my own words: We are fortunate to live in a real democracy; we are fortunate to live in a society that consents to be governed by the rule of law; we are fortunate to have a tradition of institutions of governance – the Legislature, the Executive and the Judiciary – which recognize that their legitimacy, and indeed our democracy, is founded on society's continued consent and on its continued respect for those institutions.

Today's proceedings play a part in maintaining that foundation.
