         11. — THE HONOURABLE THE MINISTER OF JUSTICE AND PUBLIC SAFETY – To Move:

 

         WHEREAS the Lieutenant Governor in Council appointed a tribunal under section 28 of the Provincial Court Act, 1991 to make recommendations on the salaries and benefits of judges and the chief judge;

 

         AND WHEREAS the tribunal submitted its recommendations to the Minister of Justice and Public Safety on December 21, 2015;

 

         AND WHEREAS the Newfoundland and Labrador Provincial Court Judges Salary and Benefits Tribunal Report was tabled in this Honourable House on March 17, 2016 as required by section 28.2 of the Act;

 

         AND WHEREAS the House of Assembly is required to approve, vary or reject the report within the period of time referred to in that section;

 

         AND WHEREAS Government has decided to ask this Honourable House to accept all but one of the recommendations of the tribunal as contained in its report of December 21, 2015;

 

         AND WHEREAS Government has decided to ask this Honourable House to reject one of the recommendations;

 

         THEREFORE BE IT RESOLVED that this Honourable House accept the recommendations of the 2015 Newfoundland and Labrador Provincial Court Judges Salary and Benefits Tribunal set out in Schedule A;

 

         AND THEREFORE BE IT RESOLVED that this Honourable House reject the recommendation set out in Schedule B for the reasons given;

 

         AND THEREFORE BE IT FURTHER RESOLVED that the recommendations of the Tribunal that this Honourable House accepts and rejects, as set out in Schedules A and B, be implemented effective April 1, 2013”.

 

         12. — THE HONOURABLE THE MINISTER OF JUSTICE AND PUBLIC SAFETY – To  Move:

 

WHEREAS subsection 6(3) of the Independent Appointments Commission Act provides that 5 members are to be appointed to an Independent Appointments Commission by the Lieutenant-Governor in Council on a resolution of the House of Assembly;

 

AND WHEREAS subsection 6(4) of the Act provides that the Lieutenant-Governor in Council designate one of the members of the commission to be chairperson;

 

NOW THEREFORE BE IT RESOLVED that the following persons be appointed members of the Independent Appointments Commission:

M. Zita Cobb

Shannie Duff

Philip R. Earle

Derek Young”.

 

13. − THE HONOURABLE THE GOVERNMENT HOUSE LEADER – To Move pursuant to Standing Order 11 that the House not adjourn at 5:30 o'clock p.m. on Thursday, May 26th, 2016.
