(1) Paragraph 2(g) of the Student Financial Assistance Administration Regulations is repealed and the following substituted: (g) "period of study" means a period of study at an educational institution that is not fewer than 6 weeks in length and not more than 52 consecutive weeks in length; (2) Paragraph 2(i) of the regulations is repealed and the following substituted: (i) "program of
study" means a program of
study that satisfies the requirements in paragraphs 3(1)(b) to (d). 2. Subsection
3(2) of the regulations is amended by deleting the words "his or her"
and substituting the words "the person's". 3. (1)
Subsection 4(3) of the regulations is amended by deleting the words "he or
she" and substituting the words "the person". (2) Subsection
4(4) of the regulations is amended by deleting the words "he or she"
and substituting the words "the person". (3) Subsection
4(6) of the regulations is repealed. 4. Subsection 12(5) of the regulations is
repealed. 5. Subsection 13(4) of the regulations is repealed. 6. Sections 18 and 19 of the regulations are repealed. 7. Sections 20 to 22 of the regulations are repealed and the following substituted: Time period to submit appeal to appeals officer 20. (1) An appeal under subsection 13(1) of the Act shall be submitted to an appeals officer not later than 8 weeks before the end of the period of study to which financial assistance being appealed relates. (2) Notwithstanding subsection (1), where the period of study is less than 12 weeks, the appeal shall be submitted to an appeals officer not later than 4 weeks before the end of the period of study to which financial assistance being appealed relates. (3) Notwithstanding subsection (1), where a person is appealing a decision relating to an overaward to which subsection 15(2) applies, the appeal shall be submitted to an appeals officer not later than the first day of the fifth month after the person ceases to be a full time student. (4) Notwithstanding subsection (1), where a person is appealing a decision relating to debt reduction, the appeal shall be submitted to an appeals officer not later than one year after the person receives the decision being appealed. Time period to submit appeal to director 21. An appeal under subsection 13(2) of the Act shall be submitted to the director not later than 30 days after the person receives the decision of the appeals officer. Appeal 22. (1) An appeal to an appeals officer or the director shall be conducted in writing. (2) Where an appeal is submitted to an appeals officer, the appeals officer shall review (a) the appeal; (b) the decision being appealed; and (c) any information and documentation submitted by the person appealing the decision. (3) Where an appeal is submitted to the director, the director shall review (a) the appeal; (b) the decision of the appeals officer; and (c) any information and documentation submitted by the appeals officer and the person appealing the decision. (4) An appeals officer or the director may request additional information and documentation that the appeals officer or director considers necessary. 8. Section 23 of the regulations is repealed. 9. Section 24 of the regulations is repealed and the following substituted: Deemed receipt 24. Unless the contrary is proven, where a decision referred to in subsection 20(4) or section 21 is sent (a) by mail, it shall be considered to have been received on the fifth day after mailing; or (b) electronically, it shall be considered to have been received on the day it is sent. 10. Section 25 of the regulations is repealed and the following substituted: Decisions 25. (1) An appeals officer shall provide a decision regarding an appeal to the person who submitted the appeal not later than 14 days after receipt of the appeal. (2) Notwithstanding subsection (1), where the decision of an appeals officer relates to debt reduction, the appeals officer shall provide the decision to the person who submitted the appeal not later than 30 days after receipt of the appeal. (3) The director shall provide a decision regarding an appeal to the person who submitted the appeal not later than 10 days after receipt of the appeal. (4) A decision of an appeals officer or the director shall be limited to the requirements of the Act, regulations made under the Act and the policies and procedures of the department and the division with respect to matters to which the Act applies.
