Town of Gander Violation Notice Regulations
under the
Municipalities Act, 1999
and the
Urban and Rural Planning Act, 2000

Under the authority of section 421.3 of the Municipalities Act, 1999 and section 39.3 of the Urban and Rural Planning Act, 2000 , I make the following regulations.

Analysis



Short title

        1. These regulations may be cited as the Town of Gander Violation Notice Regulations .

Definitions

        2. In these regulations "violation notice" means a violation notice issued in accordance with section 421.1 of the Municipalities Act, 1999 or section 39.1 of the Urban and Rural Planning Act, 2000 with respect to a regulation referred to in section 3.

Violation notices

        3. The town council of the Town of Gander may issue violation notices with respect to a failure to comply with a provision of the Occupancy and Maintenance Regulations under the Urban and Rural Planning Act, 2000 or a provision of the following regulations enacted by the town council under the Municipalities Act, 1999 or the Urban and Rural Planning Act, 2000 :

             (a)  Fences Regulations ;

             (b)  Mandatory Inspections Regulations ;

             (c)  Subsidiary Apartments/Secondary Suites Regulations ;

             (d)  Swimming Pool Regulations ;

             (e)  The Taxi and Limousine Regulations of the Town of Gander ;

             (f)  Town of Gander Accessory Building Regulations ;

             (g)  Town of Gander Animal Control Regulations, 2003 ;

             (h)  Town of Gander Building Regulations ;

              (i)  Town of Gander Civic Address Numbering Regulations ;

              (j)  Town of Gander Eavestrough and Downpipe Regulations ;

             (k)  Town of Gander Fire Alarm System, Signal and Monitoring Regulations ;

              (l)  Town of Gander Garbage and Refuse Regulations, 2002 ;

           (m)  Town of Gander Landscape Regulations ;

             (n)  Town of Gander Nuisance Regulations ;

             (o)  Town of Gander Patio Regulations ;

             (p)  Town of Gander Patios for Town Owned Parking Lots Regulations ;

             (q)  Town of Gander Sign Regulations ; and

              (r)  Town of Gander 's Open Air Fire Regulations .

Time of payment

        4. Where a violation notice has been issued by the town council of the Town of Gander

             (a)  a voluntary payment made to the Town of Gander with respect to that notice shall be made by the recipient of that notice not later than 7 days after the issuance of the notice to that recipient; and

             (b)  notwithstanding paragraph (a), a voluntary payment made to the Town of Gander with respect to that notice after the time referred to in paragraph (a) shall be made by the recipient of that notice not later than 14 days after the issuance of the notice to that recipient.

Amount of payment

        5. Where a violation notice has been issued by the town council of the Town of Gander

             (a)  a voluntary payment to the Town of Gander made within the time referred to in paragraph 4(a) with respect to that notice shall be $50; and

             (b)  a voluntary payment to the Town of Gander made with respect to that notice within the time period referred to in paragraph 4(b) shall be $75.

Offence penalty

        6. Where a person has received a violation notice and is convicted of an offence with respect to the same matter for which that notice was issued, the penalty for that offence shall be $100.

Commencement

        7. These regulations come into force on March 1, 2015.
