Cavendish Beef Farm Project Release Order
under the
Environmental Protection Act
(O.C. 2022-227)

Under the authority of paragraph 67(3)(a) of the Environmental Protection Act, the Lieutenant-Governor in Council makes the following Order.

        1. This Order may be cited as the Cavendish Beef Farm Project Release Order .

        2. In this Order, "project" means the Cavendish Beef Farm Project.

        3. The project is released from environmental assessment.

Terms and conditions of release

        4. The release of the project from environmental assessment under section 3 is subject to the following terms and conditions:

             (a)  Viking Fur Inc. shall adhere to all mitigation, monitoring and commitments stated in the Environmental Impact Statement submitted on March 25, 2022;

             (b)  Viking Fur Inc. shall submit an Odour Control Management Plan for all applicable farming construction and operation activities for the minister's approval, prior to the start of forage and pasture land construction;

             (c)  Viking Fur Inc. shall consult with the following departments in the development of the Odour Control Management Plan referred to in paragraph (b):

                      (i)  Department of Environment and Climate Change,

                     (ii)  Department of Fisheries, Forestry and Agriculture, and

                    (iii)  Department of Digital Government and Service Newfoundland and Labrador;

             (d)  the Odour Control Management Plan referred to in paragraph (b) shall describe odour sources, mitigations, public consultations and methods for complaint reporting and resolution;

             (e)  Viking Fur Inc. shall submit an Environmental Protection Plan for all applicable farming construction and operation activities for the minister's approval prior to the start of forage and pasture land construction;

             (f)  the Environmental Protection Plan referred to in paragraph (e) shall describe the environmental protection and mitigation measures that will be applied throughout the life of the project to avoid or minimize potential negative effects on the environment associated with the project and shall be updated by Viking Fur Inc. as needed;

             (g)  Viking Fur Inc. shall submit an Environmental Effects Monitoring Plan with a follow up plan for the monitoring of effects from the farm for the minister's approval prior to the start of operations;

             (h)  Viking Fur Inc. shall consult with the following departments in the development of the Environmental Effects Monitoring Plan referred to in paragraph (g):

                      (i)  Department of Environment and Climate Change,

                     (ii)  Department of Fisheries, Forestry and Agriculture, and

                    (iii)  Department of Digital Government and Service Newfoundland and Labrador;

              (i)  Viking Fur Inc. shall advise the Environmental Assessment Division of the department in the form and manner determined by the minister when the conditions of release have been met and provide the documentation required by the minister to demonstrate that the conditions have been fulfilled; and

              (j)  Viking Fur Inc. shall, one year from the coming into force of this Order and at other dates determined by the minister, provide an update of the status of the project to the Environmental Assessment Division of the department which update shall include the documentation determined by the minister.
