RSNL1990 CHAPTER E-9 EMERGENCY MEDICAL AID ACT Amended: 1997 c23 s13; 2019 c9 s26; 2024 c22 s45; 2024 cN-5.1 s54 CHAPTER E-9 AN ACT TO PROTECT PERSONS RENDERING AID FOLLOWING AN ACCIDENT OR IN AN Short title 1. This Act may be cited as theEmergency Medical Aid Act. Definitions 2. In this Act (a.01) "nurse" means a licensed practical nurse, registered nurse, registered psychiatric nurse or nurse practitioner as defined in the Nurses Act; and (a) "physician" means a person who is lawfully entitled to practise medicine in the province; (a.1) "physician assistant" means a person who is lawfully entitled to practise physician assisting in the province; and (b) {Rep. by 2024 cN-5.1 s54] 1971 No15 s2; 1997 c23 s13; 2019 c9 s26; 2024 c22 s45; 2024 cN-5.1 s54 Protection of certain persons from action 3. Where, in respect of a person who is ill, injured or unconscious as the result of an accident or other emergency, (a) a physician, physician assistant or nurse, voluntarily and without expectation of compensation or reward, renders emergency medical services or first aid assistance, and the services or assistance are not rendered at a hospital or other place having adequate medical facilities and equipment; or (b) a person other than a person mentioned in paragraph (a) voluntarily renders emergency first aid assistance, and that assistance is rendered at the immediate scene of the accident or emergency, the physician, physician assistant, nurse or other person is not liable for damages for injuries to or the death of that person alleged to have been caused by an act or omission on his or her part in rendering the medical services or first aid assistance, unless it is established that the injury or death was caused by gross negligence on his or her part. 1971 No15 s3; 2024 c22 s45; 2024 c22 s45; 2024 cN-5.1 s54 ©Queen's Printer |
