EXPLANATORY NOTE

The purpose of this Bill is to amend the City of St. John's (Loan) Act, 1978 to enable the City of St. John's to borrow money for operating and capital purposes with the approval of the Minister of Municipal and Provincial Affairs. Presently, such borrowing requires the approval of the Lieutenant-Governor in Council.

Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows:

1. Section 2 of the City of St. John's (Loan) Act, 1978 is amended by deleting the word "and" at the end of paragraph (b), deleting the period at the end of paragraph (c) and substituting a semi-colon and the word "and" and by adding immediately after paragraph (c) the following:

(d) "minister" means the minister appointed under the Executive Council Act to administer this Act.

 

2. Subsection 3(1) of the Act is amended by deleting the words "by order of the Lieutenant-Governor in Council" and substituting a comma and the words and comma "in writing, by the minister".

 

3. Section 6 of the Act is amended by deleting the words "Lieutenant-Governor in Council" and substituting the word "minister".

 

4. Section 8 of the Act is amended by deleting the words "of the Lieutenant-Governor in Council" and substituting a comma and the words and comma "in writing, of the minister".
