Endangered Species List Regulations (Amendment)
under the
Endangered Species Act
(O.C. 2022-254)

Under the authority of sections 7 and 44 of the Endangered Species Act, the Minister of Fisheries, Forestry and Agriculture, with the approval of the Lieutenant-Governor in Council, makes the following regulations.

as amended

        1. The Endangered Species List Regulations are amended by adding immediately after section 4 the following:

Extinct species

        5. The species, subspecies or populations of species listed in Schedule D are designated as extinct.

 

        2. Schedule B of the regulations is amended by

             (a)  deleting the species "Chimney Swift - Chaetura pelagica";

             (b)  deleting the species "Common Nighthawk - Chardeiles minor";

             (c)  adding immediately after the species "Hudsonian Godwit - Limosa haemastica" the species "Leach's Storm Petrel – Oceanodroma leucorhoa" and the species "Lesser Yellowlegs – Tringa flavipes";

             (d)  deleting the species "Olive-sided Flycatcher - Contopus cooperi"; and

             (e)  adding immediately after the species "Sharpleaf Aster - Oclemena acuminata" the species "Short-eared Owl - Asio flammeus".

 

        3. Schedule C of the regulations is amended by

             (a)  adding immediately after the species "Banded KillifishFundulus diaphanus" the species "Barn Swallow – Hirundo rustica";

             (b)  adding immediately after the species "Boreal Felt Lichen - Erioderma pedicellatum" the species "Common Nighthawk - Chordeiles minor";

             (c)  adding immediately after the species "Mummichog - Fundulus heteroclitus macrolepidotus" the species "Olive-sided Flycatcher - Contopus cooperi"; and

             (d)  deleting the species "Short-eared owl - Asio flammeus".

 

        4. The regulations are amended by adding immediately after Schedule C the following:
