How to Request a Review or Make a Privacy Complaint

If applicants have been denied access to requested records or information, they may file an appeal with the Information & Privacy Commissioner, who is empowered by the Act to conduct an independent review.

Similarly, the Information and Privacy Commissioner can independently review privacy complaints arising from the collection, use or disclosure of personal information by public bodies in contravention of the ATIPPA, 2015.

Applicants may ask the Information and Privacy Commissioner to:

• Review a refusal of access,
• Investigate a complaint about the extension of time limits,
• Investigate a complaint about fees charged,
• Review a request by a third party who objects to the planned release of information affecting their interests,
• Review a refusal to correct personal information
• Investigate a complaint by an individual who believes that his or her personal information has been collected, used or disclosed by a public body in contravention of the Act, or
• Investigate on his or her own motion, an issue where personal information has been collected, used or disclosed by a public body in contravention of the Act.

There are no costs associated with requesting a review or submitting a complaint to the Office of the Information and Privacy Commissioner. They can be contacted via:
